한국에서의 형사절차에서 회복적 사법의 적용은 그 동안 큰 관심을 보이지 않았으나, 2007년 소년법개정에 따른 ``화해권고제도``가 도입되고 최근에 제출된 「형법」개정안은 형의 집행을 유예하는 경우에 ``피해회복``을 명할 수 있게 됨에 따라 형 집행 단계에서 회복적 사법의 적용에 대한 관심이 높아지고 있다. 그 동안 보호관찰분야는 1989년에 소년범을 대상으로 시작되어 질적·양적으로 급속한 성장을 이루어 왔으나, 보호관찰 분야의 회복적 사법의 적용에 관해서는 구체적인 논의가 부족했던 것이 사실이다. 그러나 회복적 사법의 이념이 가해자의 피해자에 대한 원상회복 과정을 통하여 진정으로 지역사회와 재통합을 이룩하고, 이를 통하여 재범을 방지하는데 그 목적이 있다면 보호관찰 단계에서 보다 적극적으로 실천방안을 강구해나갈 필요성이 있다고 할 것이다. 이 연구는 보호관찰 영역 중 사회봉사명령과 수강명령집행 단계에서의 회복적 사법의 구체적 실천방안에 대해 검토하고자 한다. 이를 위해 먼저 사회봉사·수강명령이 회복적 사법의 모델의 범주에 해당하는지에 대한 외국의 논의들을 살펴보고, 한국의 회복적 사법의 개념을 정립해보자 한다. 아울러 현재 실시되고 있는 사회봉사명령과 수강명령의 내용 중에 회복적 사법과 관련이 있는 구체적인 내용들을 살펴보고, 향후 한국적 상황에서 이를 확대 실시할 수 있는 현실적인 방안을 모색하고자 한다.

The application of restorative justice in criminal justice process did not draw great interest for a long time in Korea. However with the introduction of ``victim-offender mediation`` in the revised Juvenile Law in 2007 and the ``reparation order`` in the revised Criminal Law in 2011, many people began to pay attention to the application of restorative justice in criminal justice practice. Although the Probation and Parole System in Korea had been introduced for juvenile delinquent in 1989 and it had achieved a great development and growth in terms of quantitative and qualitative, there was not any concern how to applicate the restorative justice in Probation. However the ideal of restorative justice is reintegrating the offender with the community by the restitution for victim and preventing re-offending of offender. Thus, Korean Probation Service needs to take a profound interest how to practice restorative justice. This report is focused at the application of restorative justice in Community Service and Attendance Center Order in Koran Probation System. For this study, it needs to research the arguments whether restorative justice contains the Community Service and Attendance Center Order in advanced countries and setting up the new concept of restorative justice in Korea. Furthermore, this study will investigate the concrete contents of restorative justice aspects in Community Service and Attendance Center Order and how to expand the restorative ideal for the future Korean Probation.
