우리나라에서는 경제발전과 더불어 신용사회 실현 및 개인정보 보호 등을 고려하여 절차적 번거로움과 실효성이 낮은 보증인제도가 폐지되고 있는 실정이다. 그러나 가족관계와 관련하여서는 출생신고, 혼인신고, 사망신고 등의 증인제도의 개선이 필요한 상황이고, 그 밖에 신원진술서 등의 보증인제도, 임원약정서의 연대보증제도, 인감신고시의 인우보증제도의 개선이 필요한 상황이다. 이러한 제도 개선을 위하여 다양한 방안이 생각될 수 있으나, 가족관계와 관련하여서는 우선 출생신고의 경우에 의료기관이나 관공서를 통한 출생증명의 확인제도를 이용하는 것이 필요하다. 또한 혼인신고와 관련하여서는 다양한 제도 구상을 할 수 있으나, 온라인을 이용한 혼인의사사실등록확인제도를 활용하는 것이 효율적일 것이다. 그리고 사망신고에는 행정검시 만을 이용하여 신고 내용의 진정성을 확보할 필요가 있다. 그 밖의 주요한 증인제도로서 우선 신원진술서 등의 보증인제도는 관련 기관의 신원진술서 등의 서식의 개선이 필요하고, 입원약정서의 연대보증제도는 연대보증인 관련 규정을 삭제하는 대신에, 저소득층에 대해서는 바우처제도를 활용할 수 있을 것이다. 그리고 인감신고시의 인우보증제도와 관련하여서는 전자본인서명사실확인 시스템을 활용하는 것이 필요할 것이다. 물론 이러한 제도 개선에 있어서는 법제적인 근거규정 및 법률의 일부 개정이 필요할 것이다. 다만, 이러한 법제적인 개선에 있어서도 전면적인 법제 개선보다는 단계적인 법제 개선을 하는 것이 국민적 법 감정에도 적정하고, 법제의 사회적 타당성과 법적 안정성의 조화에도 기여할 수 있기 때문이다.
