이 연구는 영국자치경찰과 제주자치경찰제도와의 비교고찰을 통해 한국자치경찰제도의 발전방안을 마련하기 위함이며 구체적으로 치안행정위원회와 자치경찰단장 그리고 지방자치경찰예산 등 3가지 측면에서 제언할 수 있었다. 첫째, 치안행정위원회의 정치적 중립성이 보장될 때 민생치안에 전념할 수 있으므로 현행 자치단체장 소속하에 있는 치안행정위원회를 영국지방경찰위원회처럼 독립된 법인체로 구성해야하고 권한 역시 단순 업무협조 및 관련사항에 대한 형식적 심의/의결기관이 아닌 경찰의 민주적 관리운영과 효율성 확보를 위한 권한 강화가 필요하다. 둘째, 현행 「제주특별법」 제107조는 자치경찰단장을 자치단체장의 보조기관화 하였고 권한규정 역시 어디에도 찾아볼 수 없기에 자치경찰단장의 자치단체장으로부터의 정치적 중립과 효율적 경찰활동 집행을 기대할 수 없다. 또한 자치경찰단장이 개방형직위로 운영 될 경우, 자치단체장의 자의적 인사전횡을 방지할 필요가 있고 전문지식이나 경험 없는 인물이 선출될 우려가 있으므로 단장의 권한 및 전문성 확보를 위해 법적·제도적 장치가 요구된다. 셋째, 자치경찰예산지원에 대한 법적장치 마련이다. 자치경찰의 재정문제는 자치경찰의 활성화 문제에 큰 영향을 미치는 중요한 부분이므로 「제주특별법」에서처럼의 개략적인 규정만으로는 부족하고 국고지원의 범위와 수준을 명시하여 안정적인 재정 확보 방안을 마련하여야 할 것이다.
The purpose of this paper is to attempt a development plan for South Korean Municipal Police System (SKMPS) using the British and Je-Ju municipal police system as a framework for comparison and analysis. The paper presents a development plan for SKMPS in three areas: the roles and functions of local police administration authorities (the Local Public Order Adminstration Authority - LPOAA), the roles and functions of Local Chief Police Officers (the Local Chief Autonomy Police Officers - LCAPO) and the financial arrangement in place for the maintenance of the Municipal Police System. The paper argues that: (a) The LPOAA, which is currently under the control of the Provincial Governor(PG), must be an independent corporate body with more powers to act as an autonomous body. (b) Whereas Article 107 of ``Je-Ju Special Law`` of the Republic of Korea has recently formed an auxiliary group which supports LCAPO, since there are currently no regulations, one cannot assess the competence of this body. It is argued, therefore, that South Korean Government (SKG) needs to put into place legal and organisational structures to improve the powers and operational autonomy of LCAPO. (C)The SKG needs to establish a legal system for the finances of the Municipal Police System. Adequate financial support is important in order to improve police programmes for future generations and also provide good quality public security for the local citizens.
