본 연구는 국가수사기관의 수사력이 미치지 못하거나 미흡한 분야에 대하여 민간인이 직접 사실관 계를 조사할 수 있도록 해 주는 것이 국민의 권익보호차원에서 필요하다는 인식하에 탐정제도의 도입 가능성에 대해서 살펴본 것이다. 법률상의 문제가 발생하면 변호사에게 도움을 받을 수 있둣이, 개인 의 권익에 관한 문제가 발생할 경우 범죄수사 전문가의 조력을 개인적으로 이용할 수 있는 시스템을 국가가 반대할 이유는 없다고 보겠다. 탐정제도가 우리사회에 도입되어야 하는 필요성과 도입되었을 경우 예상되는 주요쟁점들을 최근에 국회에 제안된 여러 의원들의 탐정제도 관련 법률안을 중심으로 비교분석하였다. 국민들에게 사립탐정제도의 도입에 대한 우려를 불식시키고 보다 긍정적으로 받아들 이게 하기 위해서는 단계적으로 특수한 분야에서부터 우선적으로 사립탐정제도를 허용하고, 그 범위를 점차로 확장하여 발전시켜 나가는 것이 필요한 것으로 보인다.

The purpose of this study was to analyze the possibility of adoption of detective system. There is no reason to oppose the adoption of detective system because it is more desirable to provide the opportunity of criminal expert`s assistance when individual`s rights or interests is violated like as everyone has the right to receive lawyer`s assistance when there is legal problems. The need of adoption and anticipated main issues was studied through the comparison of each Congressman`s Detective Adoption Proposals. To make the people adopt detective system more positively, it is recommended that detective system is adopted by stages in special areas rather than overall adoption.
