2008. 4. 18. 한·미 양국간 미국산 쇠고기의 수입위생조건 협상이 타결된 후 관보게재연기와 추가 협상을 거쳐 같은 해 6. 26. 미국산 쇠고기 및 쇠고기 제품 수입위생조건에 관한 고시가 최종적으로 발령되었다. 이 사건 고시와 관련하여 촛불시위가 발생하였고, 미국산쇠고기 수입과 관련된 여러 가지 헌법적, 법률적 문제가 제기되었다. 본고에서는 이 사건 고시와 관련하여 청구된 헌법소원사건이 진행되는 과정에서 논란이 되었던 정당의 청구인 적격, 이 사건 고시의 법적 성격, 자기관련성, 기본권 침해의 가능성, 생명 신체의 안전에 관한 보호의무위반, 행복추구권, 소비자의 권리, 검역주권, 위임입법의 한계 및 법률유보, 적법절차, 명확성의 원칙 등을 포함한 헌법적, 법률적 문제들을 살펴보았다. 본고에서는 진보신당의 청구인 적격이 없어 각하되어야 하고, 나머지 청구인들이 주장하는 기본권은 자기관련성 또는 기본권침해의 가능성이 없어서 각하되어야 할 것이라는 점을 지적한 후, 가사 적법요건을 갖추었다고 하더라도 청구인들의 기본권에 대한 보호의무를 위배하지 않았다는 점을 지적하였다. 현대 사회는 예측과 통제가 어려운 불확실성의 위험을 늘 가지고 있는 위험사회로서 과학적 의미에서 ``제로 리스크``는 사실상 실현이 불가능한 것이라 할 수 있다. 이번 BSE 관련 논란은 우리 사회가 식품의 안전성에 대한 자각과 함께 과학적 안전성 기준에 대한 성숙된 태도를 배울 수 있는 좋은 계기가 되었다고 보아야 할 것이다. 1988년에 설립되어 이제 성년을 넘어선 헌법재판소는 그 동안 우리 사회에서 제기된 중요한 국가적, 사회적 문제에 대하여 분명한 헌법적 판단을 통하여 국민의 인권보호와 실질적 법치주의 확립을 위한 지대한 기여를 하여 왔다. 이번 쇠고기 협상과 관련한 이 사건 헌법소원심판청구는 여러 가지 면에서 중요한 의미를 가지고 있다고 할 수 있다. 이 사건 고시로 인하여 발생한 촛불시위에서 분출된 사회적 갈등과 국가적 혼란이 헌법 재판소의 판단을 통하여 해소됨으로써 헌정생활의 안정을 이루고 사회통합을 이룰 수 있는 계기가 되었다고 판단한다. 미국산 쇠고기 수입을 둘러싼 고시의 변경으로 인하여 수많은 헌법적, 법률적 쟁점들이 주장되었고, 이에 대한 논의가 있었다. 이러한 사건에 대한 헌법재판소의 판단을 통하여 우리 사회가 한단계 더 성숙하는 기회가 되었다고 생각한다.
The Korean and US governments reached an agreement on the import health requirements for US beef on April 18, 2008, followed by the postponement of gazette-publishing and further negotiation. The notification of Import Health Requirements for US beef was finally published in the official gazette on June 26, 2008. Candlelight vigils took place in opposition to the notification, and numerous constitutional and legal issues were raised regarding US beef import. This paper examines the constitutional and legal topics that have been at the center of debate in the process of the constitutional complaint regarding the notification: the political party`s standing, the legal character of notification, self-relatedness, the possibility of the infringement on basic rights, violation of the duty to protect the health and life of the citizens, rights to pursue happiness, consumer rights, sovereignty of quarantine, the limits of delegated rule-making and statutory reservation, due process, and rule of clarity. It was pointed out in this paper that the New Progressive Party`s claim should be dismissed for lack of standing, and that the rest petitioners` complaints should also be dismissed for lack of self-relatedness or for lack of possibility to violate the basic rights. It was indicated that the government did not fail to execute its constitutional duty to protect basic rights of people even if the petitioners` complaint had the litigation capacity. Modern society carries risks of uncertainties where predictions and controls are difficult to achieve and it may be virtually impossible to realize ``zero risk`` from a scientific point of view. We might take the BSE-related controversy as a good opportunity for our society to practice maturer attitudes toward the scientific safety standards as well as realize the importance of the safety of food. The Constitutional Court, which was founded in 1988 and came of age, has significantly contributed to the protection of human rights and the establishment of the substantial rule of law by providing clear constitutional judgments on national and social issues. The constitutional complaint in relation to the beef agreement has important implications in many aspects. The Constitutional Court`s decision helped to resolve the social conflicts and national disorder that were unleashed by candlelight vigils following the notification. With the change of the notification about US beef imports, various constitutional and legal issues have been raised and debated. I believe the Constitutional Court`s decision on this case helped to pave the way to a maturer society.
