오는 8월 24일에 김영란 대법관이 6년 임기만료로 퇴임하게 되어 있다. 이에 따라 대법원은 후임자 인선작업에 착수했다. 김영란 대법관이 대법관에 선임되던 지난 2004년에, 성향이나 성별 등 여러 면에서 다양한 대법원의 인적 구성을 갈구했던 시민사회의 요구가 받아들여져서, 기수와 서열 위주의 종래 대법관 선임관행에서 벗어나 일종의 파격인사가 이루어졌었다. 대법원은 최종적인 법해석과 법적용의 막강한 권한을 가진 국가기관이다. 또한 대법원은 최종심으로서 국민의 인권을 보장하는 최후의 보루이자, 구체적인 사건을 통해 정책적 판단을 내림으로써 우리 사회가 나아갈 방향을 제시하는 막중한 역할과 기능을 수행한다. 따라서, 대법원을 구성하는 대법관의 임명이 얼마나 중요한 지는 새삼 강조할 필요조차 없을 정도다. 바로 여기에 대법관 인선기준의 중요성이 존재한다. 특히 대법원의 인적 구성은 다양화될필요가 있다. 12명의 대법관 임명 제청권을 가진 대법원장이 다종다양한 배경을 지닌 인사들을 대통령에게 대법관 후보로 제청함으로써, 국민 각계각층의 다양한 이익과 의사를 대법원 판결에 두루 담아낼 수 있어야 하는 것이다. 본 논문에서는 우선 과거 시민사회가 제시했던 바람직한 대법관 인선기준을 되짚어보고, 이런 기준에 비추어 봤을 때 김영란 대법관의 대법관으로서의 업무수행은 어떤 평가를 받을 수 있는지를 분석해본다. 그리고 이를 근거로 김영란 대법관의 후임 대법관을 비롯한 장래 대법관들의 바람직한 인선기준은 어떤 것이어야 하는가를 규명함을 연구의 목적으로 한다.

Justice Young-Ran Kim is supposed to retire on August 24th this year completing her 6 year tenure. The Supreme Court has already started the selection process for the new Justice. In the year of 2004 when Justice Kim was appointed as a Justice, it was evaluated as an unprecedented appointment which admitted a long-time demand from Korean civil society having longed for a diverse bench in Korean Supreme Court in terms of the gender and political position. Meanwhile, it was an effort by the Korean Judiciary to break itself of a bad habit to select a Justice only based on the ranking and the bar-passing year as well. The Supreme Court has great powers in interpreting and applying laws into real cases. In addition, it is the final safeguard to protect people`s human rig rs and the critical institution to decide on the future course of the society through judicial decisions on the controversial issues of the society. The importance of the selection criteria of the Supreme Court Justices exists here. In particular, Korean Supreme Court mostly needs to be diversified in the composition of the bench in order to reflect the interests of all sorts and conditions of people in the decision. This paper reviews the selection criteria for the Supreme Court Justices at first which was suggested by the civil society in Korea. Then, it will analyze and evaluate major cases by Justice Young-Ran Kim based on the criteria. Through these, this paper aims at presenting the desirable selection criteria for the future Justices in Korea including Justice Kim`s successor.
