헌법학계에서는 기본권 중에서도 양심의 자유, 종교의 자유, 학문 및 예술의 자유와 같은 내심작용과 관련된 기본권들, 그리고 언론, 출판, 집회, 결사의 자유와 같은 표현의 자유를 통틀어 ``정신적 자유권``으로 분류한다. 이 정신적 자유권은 이중기준의 원칙 등에 의해 웬만하면 그 제한이 위헌인 상위의 기본권으로 인정된다. 2000년부터 2006년까지 활동한 제3기 헌법재판소가 많은 기본권들 중에서 이정신적 자유권과 관련해 어떤 판결성향을 보여주고 있는가를 규명해내는 것이본 연구의 목적이다. 이를 위해 우선 정신적 자유권과 관련한 제3기 헌법재판소의 주요 판결들을 면밀히 분석해 정성적 방법을 통해 이와 관련한 제3기 헌법재판소의 판결성향을 도출해본다. 종교의 자유와 관련해서는 2001년의 사법시험 제1차 시험 시행일자 사건, 양심의 자유와 관련해서는 2002년의 준법서약제 사건과 2004년의 양심적 병역거부사건, 언론·출판의 자유와 관련해서는 2001년의 영상물등급위원회 등급보류결정 사건, 집회의 자유와 관련해서는 2005년의 집시법상법원 부근 집회금지조항 사건을 분석한다. 그 다음으로 제3기 헌법재판소의 결정들 중 정신적 자유권과 관련된 사건들을 전수조사하여 이를 결정유형별로 통계화해 살펴봄으로써, 제3기 헌법재판소의 정신적 자유권 관련 판결성향에 대한 정량적 평가를 시도해본다. 이러한 작업을 통해 끝으로 정신적 자유권과 관련한 제3기 헌법재판소의 종합적인 판결성향도 도출해본다.

The Freedom of Conscience, the Freedom of Religion, the Freedom of Learning and the Arts and the Freedom of Expression are classified as ``Mental Freedoms.`` These Metal Freedoms are regarded as a highly-positioned fundamental right whose restrictions are presumed to be unconstitutional. This paper aims at revealing the judicial inclination of the Third Korean Constitutional Court on the cases concerning Mental Freedoms which existed from the year of 2000 to 2006. To achieve this aim, it analyzes major cases of the Third Korean Constitutional Court on the Mental Freedoms and explores its judicial inclinations such as the judicial passivism and the judicial conservatism. The major cases are Bar Exam Date Case in 2001 on the Freedom of Religion, Law-abeding Oath Case in 2002 and Conscientious Objection against Military Service Case in 2004 on the Freedom of Conscience, Korean astion Picture Rating Burery Case in 2001 and Assembly Act Case in 2005 on the Freedom of Expression. Then, this paper analyzes the judicial inclination of the Third Korean Constitutional Court on the Mental Freedoms based on the statistics of the decisions which the Court made. In the conclusion, it tries to reveal the overall judicial inclination of the Third Korean Constitutional Court on the Mental Freedoms.
