실체적 진실발견을 위한 형사절차의 진행과정에서 수사기관에 의한 체포권 남용으로부터 국민의 인권을 보호하기 위해 1995년에 체포제도가 도입되었다. 그러나 체포요건의 엄격성과 관련법 규정의 불충분 등으로 수사실무에서는 여전히 영장에 의하지 않은 체포, 특히 현행범체포가 남용되고 있다. 이 연구에서는 이에 대한 방지대책의 입법론적 방안으로 현행범 체포 후에 지체 없이 법관에게 인치하고 사법경찰관의 경우 체포 즉시 검사의 승인을 받을 것과 현행범의 실행직후개념과 관련 경찰관의 정확한 법집행을 위해 개념을 명확하게 규정할 것, 경미범죄 현행범체포 요건에 범인의 성명이 불명과 도주우려가 있는 경우를 삽입하도록 하고, 실무상 방안으로 경찰관들의 의식개혁과 전문성 향상을 위한 소양교육 강화를 제시하였다.
The nation has the responsibility to protect the integrity and values of human beings along with the duty to realize judicial justice by exercising the right to punish criminals. However, in the process of realizing the right to punish criminals, it is unavoidable for the nation to encroach upon the human rights of the suspect when there is a possibility that effective investigation is hampered. In this case, the two ideals of the human rights and the necessity of investigation collide, bringing up the issue of harmonizing the two. In our history, there was a time when the necessity of investigation was preferred to respecting the human rights. In an effort to improve this unsatisfactory situation, a new arresting system was introduced in 1995, but the requirements for arrest were so strict and unrealistic that the arrest without a warrant - in particular, arresting a flagrant offender - was abused in a rampant manner among law-enforcement agents. In order to improve this, some suggestions which this study makes are as follows. First, in order to revive the original purpose of the arresting system, the rejection of attendance or rejective apprehension of attendance contained in the paragraph 1 of the Article 200-2 of the Criminal Procedure Code should be deleted. And an arrest warrant should be issued in cases which have a reasonable cause, and a judge should decide whether the suspect may remain arrested continuously. Second, For an exact enforcement in police, the concept of ``right after the criminal act`` should be clearly defined. Third, the provisions of arresting a flagrant offender which are completely independent of the warrant system should be revised so that any arrest should go through judicial review by the court to prevent any abuse by the police. Fourth, the following should be added to the requirements for arresting a flagrant offender in a minor offence : cases of his unknown residence or name and his rejection of identification or his escape. In addition, it is the most important thing that the police make efforts to improve their professionalism.
