공소시효는 검사가 일정기간 동안 공소를 제기하지 않고 방치하는 경우에 국가의 소추권을 소멸시키는 제도이다. 이 제도는 범죄 후 수사가 개시되지 아니한 경우뿐만 아니라 범죄 후에 범인이 도피한 경우에도 원칙적으로 적용된다. 그 이유는 첫째, 오랜 시간이 지나면 실체적 진실을 발견하기 어렵기 때문이다. 둘째, 법질서가 회복되어 처벌할 필요성이 없기 때문이다. 셋째, 일반인의 처벌 욕구가 감소되었기 때문이다. 넷째, 범죄인이 도주하는 과정에서 형벌과 같은 고통을 받았기 때문이다. 따라서 공소시효 기간이 완성되었다면 소급 입법하여 공소시효의 기간을 연장하거나 배제할 수 없다. 왜냐하면 새로운 형벌을 만들어 처벌하는 것과 같기 때문이다. 그러나 모든 사람에게 공소시효제도를 적용시켜서는 안 된다. 그 이유는 첫째, 국가권력의 구성원인 공무원이 헌법과 법률을 위반하여 정당한 사유 없이 시민들에게 반인권적 범죄를 행하고 그 행위를 조직적으로 은폐하는 경우가 있기 때문이다. 둘째, 반인권적 범죄일 경우에 일반인의 처벌 욕구가 여전히 존재하여 진정한 법적 평화가 결여되었기 때문이다. 셋째, 반인권범죄에 대한 실체적 진실발견을 외면할 경우 국가와 법질서에 대한 국민들의 신뢰가 저하되기 때문이다. 이러한 경우에는 예외적으로 소급입법을 인정해야 한다. 따라서 개인의 이익에 따른 신뢰보호보다 공공의 이익이 우선하는 것이 실질적 정의와 법적안정성에 부합될 때에는 공소시효를 연장 또는 배제하여야 한다.
