유럽경쟁법(EU Competition Law)은 공정하고 친경쟁적인 시장 환경을 조성하기 위한 정치적·경제적인 요구에 의해 발전되어 왔다. 또한 유럽연합은 경쟁법을 통하여 여러 가지 각도에서 시장의 통합을 증진시켜왔다. 특히, 경쟁법은 유럽 내에서 기업 활동이 비차별적인 환경에서 이루어지도록 중요하게 작용해 온 것이 사실이다. 결국 유럽경쟁법은 전통적으로 건실한 시장을 위한 주요한 동력이었으며, 동시에 유럽의 연방화(Federalisation)를 구축하는데 주요한 요소로 평가되어 왔다. 그러나 유럽위원회(EU Commission)가 경쟁법의 여러 목적을 조화시키는데 많은 어려움이 있다. 특히 일부 학자들은 비경제적 혹은 사회적인 법의 목적이 경쟁법과 경쟁정책의 경제적 효율성이라는 목적과 충돌하면 이러한 부조화현상이 두드러진다고 지적하였다. 과연 유럽경쟁당국이 경쟁정책에서 효율성 증진에 역점을 두어야 할 것인지 아니면 다른 사회적 혹은 정치적 목표를 더 강조해야 할 것인지는 여전히 문제점이 되는 것이다. 이 논문은 법의 사회정치적 고찰을 통해서 유럽경쟁법의 목적이 비경제적인 과제에 초점을 두어야 할 것인지, 아니면 경제적 효율성에 중점을 두어야 할 것인지에 대해 논의하고자 하였다. 이를 바탕으로 조금 더 효율성을 추구하는 경쟁법 관련 입법을 기반으로 하여, 다양한 법의 목적을 달성하기 위한 방향을 제시하였다. 본 연구를 시작으로 더욱 많은 비교법제연구를 통하여 각국의 경쟁법을 연구하여 국내 관련 규정을 발전시킬 수 있을 것이다.

EU competition law has developed through political and economic demands for achieving fair and pro-competitive market environments, thereby improving the internal market. In particular, competition law has functioned as a major means for ensuring non-discriminatory business activities. Accordingly, it has been traditionally regarded as the driving engine for the sound market and for the establishment of federalisation of the EU. However, there are some difficult tasks for the European Commission to harmonise various goals of EU competition law. Commentators argue that there are some clashes between the goals when non-economic or social goals come into conflicts with the objective of economic efficiency in competition law and policy. Then, one may question whether the EU competition regime should focus only on improving efficiency, which is one of the most favored languages in other competition law jurisdictions, or on ensuring other social and political policy goals. This article intends to examine whether the goal of EU competition law is to seek the non-economic objectives or to improve economic efficiency. It also aims at discussing the efforts for harmonising various goals through adopting more efficiency-based legislation.
