본 연구는 주거권의 도덕적 근거를 고찰했다. 주거권에 대해서 정책적 논의는 지속되어 왔으나 주거권의 본질에 대한 연구는 많지 않았다. 따라서 본 연구는 주거권을 정당화 할 수 있는 근거를 도덕적 측면에서 뒷받침하고자 했다. 주거권이 인간의 권리로 자리잡기 위해서는 타당한 이유가 있어야 할 것이다. 본 논문에서는 우선 신과 자연과의 관계 속에서 인간의 권리와 인간 사회 속에서 인간의 권리를 조망함으로써 도덕적 토대를 찾아보고자 했다. 다음으로 인간의 권리로서 주거권이 어떻게 정당화될 수 있는지 사회적 의미와 자연적 근거를 제시하고자 했다. 인간은 다른 동물과 달리 집을 통해 육체적 보호뿐만 아니라 심리적 보호를 하는 존엄한 존재이다. 주거권이 인간의 권리로서 자리 잡아야 하는 도덕적 뒷받침이 있는데도 현재는 UN 등의 선언에 형식적으로만 의존하고, 국내제도 속에서의 적용은 취약하다는 점을 알 수 있다. 앞으로의 주거권에 대한 관심은 단순히 당사자 중심의 운동이나 국제적 구호에 머물러서는 안 될 것이다. 어떤 사람들은 주거권은 보편적 인권이 될 수 없다는 시각에서 오직 현실정책 속의 개인적 권리로 보지만, 이 논문에서는 주거권은 인간의 존엄성 보호를 위한 하나의 보편 인권(도덕적 권리)으로서 자리 잡아야 하며, 도덕적 권리를 기반으로 한 현실정책으로서 실현되어야 할 것이라는 제안을 했다.

In this paper I studied on housing rights based on moral rights. There had been many studies about housing rights. In spite of these studies the moral-based approaches are rare. Therefore, this paper focused on the foundation of housing rights from the perspective of moral rights. The connection between moral rights and housing rights is not clear. Adequate housing is needed by all living things including humans. Is man such a special living thing to have a house? I presented that the people have human dignity. The house protects the human dignity physically and psychologically. So, humans are special living things that need shelter The housing rights could be justified by moral rights and civil rights. Man has a right to housing expressed in moral rights and in Economic, Social and Cultural Rights. The moral rights come from natural law and human dignity and the civic rights come from social covenant or contract. First of all, I insist on the importance of moral rights There is nothing in domestic law that guarantees an individual`s right to adequate housing. Somebody may think housing rights is not moral rights. I have critically examined that housing rights is only connected to the policy problem. The government should recognize and promote the concept of human`s moral rights as the most important basis for man to be provided adequate housing. The moral-based approach would realign and improve the policy on housing rights.
