이 글은 소말리아 해적과 해적활동의 내용을 분석하면서 두 가지 차원에서 접근하고 있다. 하나는 해적 활동이 지닌 안보적 측면에서, 다른 하나는 국제·정치·경제적 측면에서 어떤 의미를 지니는지의 문제이다. 해적 활동은 선박의 재물을 훔치는 좀도둑의 행태에서 화물과 선박 전체를 강탈하는 조직범죄에 이르기까지 광범위하지만 대부분 경제적인 동기에서 비롯되고 있다. 따라서 해적 활동은 ‘기회주의적 약탈’이라는 범죄 성격을 지닌다. 소말리아 해적은 그들이 목표로 하고 있는 대상과 인식의 측면에서 전통적 해적과는 차이를 지닌다. 첫째, 소말리아 해적은 화물이나 선박이 아닌 선원을 대상으로 하고 있다. 이러한 배경에는 인간 생명 가치에 대한 소말리아와 서구의 인식 차이를 충분히 활용하려는 계산이 깔려 있다. 둘째, 소말리아 해적들은 해적 활동 자체를 일종의 수익률이 높은 산업으로 인식하고 있다. 국제사회는 강력한 해군력을 가지고 소말리아 해안, 아덴만 그리고 인도양 전역에서 군사작전을 수행하고 있다. 그러나 해적의 활동 범위와 몸 값 상승이라는 부정적인 효과를 가져왔으며, 근본적으로 해결하는데 한계를 지니고 있다. 결국 유엔 중심의 국제사회가 소말리아 육지의 정치세력, 이슬람 세력과 부족 그리고 군벌들 사이에서 발생하고 있는 여러 문제들의 정치적 해결만이 해적 활동을 완화하거나 근절시킬 수 있는 근본적이 해결책이라 할 수 있다.

The purpose of this article is to analyze a various of implication of the piracy in Somalia. The piracy in Somalia is a symptom of serious underlying constraints that have been afflicting the country and the countries in the Horn of Africa for a long time. It can also be stated categorically that the advent of the piracy could be ascribed to the virtual negligence of the Somalia issue by the international community. The consequence of the instability and continued abject poverty in Somalia is that some people without any hope or positive prospects have resorted to extreme measures for their very survival including the perpetration of the crime of piracy. For the few, the chaos in Somalia has presented them with a unique opportunity to engage, without any local restraint, in a daring series of piracy which has now reached serious proportions for the international community. In order to rid Somalia of the crime of piracy, it is absolutely essential to apply comprehensive or holistic measures that respond to the underlying issues which are prevalent in the country as well as the Horn of Africa.
