1990년 12월 18일, 국제연합(United Nations: UN)은 "모든 이주노동자와 그 가족의 권리보호에 관한 국제협약(이하 `국제이주노동자권리협약` 혹은 `협약`)을 채택하여 국제적 차원의 이주노동자보호를 위한 법적 근거를 마련하였다. 이 협약은 2003년 7월 1일자로 공식 발효하였다. 2009년 8월 10일 현재 42개국이 이 협약에 가입하고 있으나 우리나라는 아직 가입하고 있지 않다. 이제 우리나라도 이미 다문화사회에 진입하였고, 약 60만명 이상의 이주노동자가 체류하고 있는 현실을 고려해볼 때 이제 본격적으로 협약의 비준을 둘러싼 법적 쟁점에 대해 논의할 시기가 되었다고 본다. 그 주된 내용은 이주노동자권리 협약과 국내법과의 정합성 여부에 대한 검토라고 생각된다. 이에 본고에서는 협약의 여러 권리 가운데 자유권 관련 쟁점, 특히 추방과 신체의 자유에 대해 살펴본다. 이를 위하여 먼저 제2장에서 이주노동자의 개념 정의와 그 해석상 쟁점에 대해 검토한 후 제3장과 제4장에서 각각 이 협약에 규정된 자유권 가운데 이주노동자와 그 가족의 추방과 신체의 자유를 중심으로 야기되는 사안에 대해 분석한다. 그리고 결론에서는 EU의 경우를 중심으로 우리나라를 포함한 선진국들이 이 협약의 비준을 꺼리는 이유에 대해 알아보기로 한다.

On December 18, 1990, the United Nations(UN) has adopted "International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families"(Int`l Convention on Migrant Workers: ICMW) in order to prepare a legal basis for protecting migrant workers in international level. The ICMW entered officially into force on July 1st, 2003, but the Republic of Korea does not yet ratify it. Considering the actual reality that the migrant workers over 600,000 persons stay in our country, it is necessary to discuss the legal issues on the ratification of the ICMW. The main issues will be especially concerned with the compatibility between the korean domestic law and the ICMW. Therefore this article examines some critical issues concerned in particular expulsion and right to liberty among the rights disposed under the ICMW. After study problems on the definition of migrant workers and its interpretation in the chapter 2, we will analyse two issues about expulsion and rights to liberty in the chapter 3 and 4. And, in conclusion, we will try to find out the reason that the developed countries including the Korea in the case of the European Union avoid to ratify the ICMW.
