범죄현상을 규명하기 위한 원인론적 접근 중 개체를 둘러싸고 있는 환경적 요인에 주목하는 시각이 범죄사회학적 입장이다. 사회적 관점에서의 범죄이론은 사회적 조건과 사회구조, 문화 등 다양한 요소에서 그 원인을 찾고 있다. 지난 10여년 전 발생한 지존파 사건은 범인들 스스로 자신들의 범행이 잘못된 사회구조와 불공평한 사회 분위기 때문이라고 적극적으로 항변한 특이한 사건이다. 사회와 가진 자에게 책임을 돌리는 자기 합리화로 시종 일관했던 그들에 대해서 검찰은 그들의 범행동기가 표면적으로는 사회의 부정적 측면에 있는것 같으나 실지로는 자신들의 행동을 은폐하기 위한 소영웅주의에서 비롯된 것이라고 일축한 바 있다. 지존파의 주장과는 상관없이 그들의 범죄행각을 살펴보았을 때 때로는 범죄사회학 이론에서 제기된 내용과 현상적 측면에 있어서 어느 정도 일치하는 면이 적지 아니하다. 사회적, 경제적 불평등, 가족 구성원과의 비통합성, 학교생활의 부적응으로 인한 정상적 학교교육기회의 부재, 범죄와의 접촉경험 등에서 비롯된 분노와 증오로 뭉쳐진 비행하위집단의 결성, 상호간의 학습을 통해 범죄를 준비하고 실행해 나가는 과정에서 보여주고 있는 중화기술의 사용 등이 그것이다. 범죄의 발생은 비단 사회학적 측면 뿐 아니라 그 원인에 있어서 다양하고 복잡하며 여러 가지 요소들이 상호 복합적으로 영향을 미친다. 그러나 지존파 사건에 대한 범죄사회학적 접근을 통하여 급격한 사회변화를 겪고 있는 한국 사회에서의 범죄사회학적 요소는 범죄의 원인이나 발생과정에 적지 않은 영향을 미치고 있음은 물론 범죄자들로 하여금 자신들의 행위를 정당화하고 합리화시키는 구실을 제공해 주기도 한다는 점을 인식하여야 할 것이다.

To identify the reason of criminal phenomenon, there are different methodical approaches. Among these, criminal sociological theory focuses the environments that surround an individual. Criminal sociological theories search for the reasons within social condition, social structure and culture. The Ji-Jon, kidnap and homicide criminal case was happened 10 years ago. The case was extraordinary because criminal insisted they were not guilty and society and millionaire responsible for their criminal behavior. They denounced the problem of social structure and relative deprivation, imbalance of economic status. The prosecutor concluded that their denouncement to the society and rich comes from worthless heroism. But whether their insistence was right or not, there are some coincident aspects with their criminal processing and criminal sociological theory. For example, the criminals were breeding under social and economic imbalance, they sustained bad relation among family member due to divorce or death of parents, they had not minimum educational opportunity, they experienced criminal career they could organize the criminal group naturally. The anger and hatred comes from relative deprivation made them unregretful criminal easily. They learned criminal skills from peers and they accustomed to use neutralization techniques. They tried to escape from the liability of the accused. We identify that the crime was due to not only sociological reason but different kind of reasons biological, psychological aspects. But among these, under Korean society, the roles of sociological factor affect the criminal behavior very deeply. Many criminal accustom to use the skills and techniques of self rationalization and learning that was appeared at criminal sociological theory.
