과학수사는 변사자의 억울한 죽음에 대한 진실을 규명하고 인권을 보장하는 최선의 수사기법이라고 할 수 있으나 우리나라는 과학수사가 열악한 수준에 있다고 할 수 있다. 앞으로는 과학수사에 관한 국가적인 관심과 지원이 절실히 요청된다. 이를 위해서는 다음과 같은 방안이 강구되어야 한다. 법의학적인 측면에서 첫째, 검시의 주체 및 대상을 명확하게 관련법규에 명문화하여야 한다. 검시의 주체는 현행법상 법의학지식이 부족한 검사로 되어 있으나 법의학자식이 풍부한 법의학자가 검시의 주체로서 역할을 수행해야 하고 검시의 대상도 한건이라도 억울한 죽음이 발생하지 않도록 관련 법규에 죽음의 유형을 규정해야 할 것이다. 둘째, 전국에 의과대학에 법의학교실이나 과학수사대학원을 설치·운영하여 법의학을 전공한 자에 대해서는 법의병리전문의 자격증을 부여하는 방안을 검토해야 할 것이다. 셋째, 부검기관인 국립과학수사연구소가 수사기관인 경찰소속으로 되어 있어 정치적 영향력을 배제할 수 없고 공정성과 객관성을 확보하기 어렵기 때문에 국립과학수사연구소의 기능 중에서 법의학기능을 분리하여 제3의 기관인 의과대학의 법의학교실 등에서 부검을 담당하도록 함으로써 부검기관의 독립성을 강화할 수 있을 것이다. 법과학적인 면에서 첫째, 현재 2부로 운영되고 있는 국립과학수사연구소의 기능을 법생물학부, 법화학부, 법공학부, 범죄행동과학부, 증거분석부로 조정하여 5개부로 확대개편해야 할 것이다. 둘째, 국립과학수사연구소에서 유전자자료은행을 설치할 수 있도록 `유전자자료은행의 설치와 운영에 관한 법률` 을 조속히 입법화하여 법무부의 교정국, 보호국과 협력하여 교도소의 수형자와 보호관찰대상자를 대상으로 혈액을 채쥐하여 유전자자료은행을 설치해야 할 것이다. 이와 동시에 관·학·민 삼원 협력체제 구축의 측면에서 국립과학수사연구소, 대학, 민간연구소가 과학수사에 관한 연구, 교육, 실무 등에 관한 정보를 교환하거나 협력체제를 구축하면 우리나라의 과학수사발전은 한층 전망이 밝다고 할 수 있을 것이다.

Scientific investigation is investigative technique that detect the truth on falsely charged with death and guarantee human right, however, there is poor surroundings in Korea. Therefore, it is necessary to provide national concern and assistance. In order to develop scientific investigation, we must take measures as follows. In terms of medical jurisprudence, the subject and object of autopsy is regulated in laws concerned and forensic pathologist is trained and educated in medicine college and graduate of scientific investigation, Because National Institute of Scientific Investigation is belongs to national police agency, there is problem in that political influence cannot be excluded. Therefore, medicine college as neutral agency will take responsibility of autopsing. In terms of forensic science, National Institute of Scientific Investigaton must coordinate functions magnificantly and National DNA Index System is administered in National Institute of Scientific Investigaton In addition, it is necessary that tripartite cooperation system(office, university, civillian) execute scientific investigation by exchanging infomation about research, education, practice.
