본 논문에서는 지난 제19대 대통령 선거 전후의 일련의 과정을 통해 나타난, 현대사회에서의 민주주의 실현 양상에 대해 살펴본다. 특히, 네트워크화 된 사회를 반영하는 소셜미디어의 영향을 중심으로 앞으로 우리 사회의 민주주의가 어떤 형태가 될 것인지 예상하고, 그 속에서 개인의 자세에 대해 생각해 본다. 그것을 위해 먼저 루돌프 폰 예링의 법과 권리에 대한 생각에 대해 알아본 다음 지난 박근혜 대통령 탄핵과정부터 시작하여 제19대 대통령 선거과정에서 나타난 권리투쟁에 대해 살펴본다. 개인의 권리를 위한 투쟁이 어떻게 사회 공동체의 권리를 위한 투쟁으로 바뀌는지에 대한 설명을 위해 먼저 개인의 총합으로서의 대중이 아닌 특이적인 개인들이 공통의 요소를 공유하는 형태로 나타나는 다중을 권리 투쟁의 주체로 소개하고, 이러한 다중이 발생하는 배경으로 소셜미디어로 대표되는 온라인상의 사회구조와 오프라인 세계의 사회구조가 갖는 척도 없는 네트워크의 특성을 살펴본다. 개인의 투쟁은 복잡계 네트워크의 연결성을 타고 흘러 바로 사회의 투쟁, 법의 투쟁이 된다. 현대사회의 민주주의는 거대한 담론의 형성과 그에 따른 위대한 혁명가 혹은 순교자가 이끄는 방식으로 실현되는 것이 아니라 네트워크의 노드를 이루는 하나하나의 개인이 이끄는 것이다. 우매한 군중의 정치 참여가 아닌 특이적인 다중의 정치 참여가 새로운 민주주의의 실현 방식이다. 그러므로 우리는 각자 특별한 개인으로써 개인의 권리를 위해 투쟁하여야 한다. 그것이 현대사회의 민주주의를 완성시키는 길이다.

In this paper, we look at the democratic approach in contemporary society, which has been shown through a series of steps before and after the 19th presidential election. Especially, Based on the influence of social media reflecting a networked society, we expect what form of democracy in our society will be and think about the attitude of individuals in it. For this purpose, Rudolf von Jhering's ideas about law and rights are studied at first. Then, we study about realization of the struggle for law in series of events, which start with the impeachment of president Park Geun-hye and end with the 19th presidential election. In order to explain how the struggle for individual rights turns into a struggle for the rights of the community or law, it first introduce ‘multitude’ as the subject of the struggle. Multitude is not a sum of individuals, but an un-mediated, revolutionary, immanent, and positive collective social subject. Next, we study about characteristics of scale-free network which is founded in the on-line society represented by social media and the structure of off-line society. Those characteristics form the background of the struggle for law in contemporary society. The struggle of individual flows through the connectivity of complex network and becomes the struggle for the rights of the community or the struggle of law. Democracy in modern society is not realized by the formation of a discourse with leading of great revolutionary or martyr. It is realized by individuals which form nodes in network society. The participation of special individuals in politics, not a foolish mob, is a new way of realizing democracy. Therefore, we must fight for the rights of each individual as a special one. That is the way to complete democracy in contemporary society.
